Academic sees traveston dam council mergers as 'big victory for oil and gas'

Oil and gas producers and environmental groups are celebrating a legal win in the Federal Court in Tasmania.

It's a big victory for Australia's fossil fuels, and a small victory for conservation, but it also means there will be little regulation for the environment for the foreseeable future.

The Tasmanian Conservation Law Foundation and environmental group Greenpeace say they saw traveston dams as a significant "tough nut to crack" when it came to protecting Australia's rivers, which are critical for managing water quality and flood risk.

The two-year hearing in the Federal Court of Tasmania is expected to last the next few weeks.

The decision will mean only government projects will be covered, with a few industry-funded projects still on the fence.

Tasmania's Environment Minister Mark Lawson said the ruling would help clear the way for the industry to get onto commercial projects.

"I can see it now as a positive step forward for the environment, but for oil and gas producers and environmental groups the fact that they have managed to persuade a federal court to agree that the projects will be included means that is a victory of a sort for the industry," he said.

"I think there will be some questions, but I believe that is probably the biggest win that we've had, and it's not an easy victory but it's a big win."

Professor Roger Watson has seen the industry's potential benefits.

He said the ruling meant only Government projects would be covered, with a few industry-funded projects still on the fence.

"The government really needs to work hard to work with the industry to make sure these projects are protected and to deliver what's required from the Federal Government in the event of a major spill, because they need to keep their own resources clean," he said.

Hookes urges warne to speak out: 'Not by any means'

The US Navy has called on the US Senate to block President Barack Obama's nomination of former Navy Captain Robert E Lee as a special envoy for countering violent extremism, calling it "not by any means" in the best interests of troops on the ground.

In a letter submitted to the US Senate Armed Services Committee on Tuesday, Hookes says he is convinced that Lee would be "a very bad choice for any ambassador given that he is white, male, Christian and deeply conservative in his views and worldview."

But, he adds, the US "does not see how a service member with such views would be able to be an effective advocate for our interests in the Middle East — particularly in a situation where radical elements on the ground continue to undermine international efforts to bring an end to violence, which threaten the interests of the United States."

Lee, who served as lieutenant commander in the Navy, had faced an avalanche of criticism last month for endorsing a racist monument to Confederate Gen. Robert E. Lee in Charlottesville, Va., on Aug. 12 that sparked a violent clash between protesters and far-right militants.

"As one of the United States' greatest leaders, Robert E Lee represented American values all too well, and it is especially troubling that those who wish to deny our heritage and historical responsibility to those who fought for our freedom should choose to overlook that Lee came from a religious background and that he served as a general in the American Army," Hookes wrote.

"That's no less true today for any American military officer who is called upon to advocate for the safety of US or allied personnel, particularly those at risk from violent extremists who threaten not only national security, but also lives and freedom in our nation and around the world."

Hookes, chairman of the US Advisory Commission on Islam and the Crusades, also says Lee's views on civil rights and other civil liberties issues "do not appear to be aligned with those of the American people."

The letter was signed by 10 Democratic and Republican lawmakers and two Republican allies: Representative Dana Rohrabacher of California and former House Speaker Newt Gingrich.

Lee had been nominated by President Obama to serve under then-Senator McCain, a South Carolina Republican, for the position of special envoy on countering violent extremism.

But Lee was forced out of the fight over the military post in 2011 after he told a reporter that he is "very concerned about the potential for civil disobedience" on U.S. soil, even if he holds no ill will towards the president or his administration.
